Plixie Terms of Service

These Terms of Service (the "Terms") are a legal agreement between you and OpsDesigner, doing business as Plixie ("Plixie," "we," "us," or "our"), governing your access to the Plixie website, application, Cast Mode, and related services (collectively, the "Service").
By creating an account, accepting an invitation, purchasing a subscription, or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and family accounts
You must be at least 18 years old and legally able to enter a contract to create or manage a Plixie household, start a subscription, or act as the household's parent or guardian.
A user who is at least 13 but under the age of legal majority may use a linked household account only with the permission and supervision of a parent or legal guardian. A child under 13 may be represented only by a parent-managed household profile and may not create an independent Plixie login. The adult household manager is responsible for child and teen use of the Service and for the information added about them.
2. Accounts and household roles
You must provide accurate information, keep it current, protect your credentials and invitation codes, and promptly tell us about suspected unauthorized access. You are responsible for activity under your account unless caused by Plixie's breach of these Terms or applicable law.
Plixie allows people to join a shared household with different roles. Household content may be visible to other members according to their role and the feature involved. A person accepting an invitation must confirm that they intended to join the named household. Adult household managers are responsible for:
- inviting only people who should have access;
- assigning appropriate roles and permissions;
- removing access when it is no longer appropriate;
- supervising minors and shared household devices; and
- resolving household disputes over shared content or access.
Unless the Service states otherwise, any parent role in a household may manage the household subscription and billing portal. Actions taken by one authorized parent, including cancellation, may affect access for every member of the household.
3. The Service
Plixie may provide household calendars, connected-calendar synchronization, chores, assignments, meal planning, recipes, grocery lists, invitations, Cast Mode, and related features. Features may change as the Service develops.
Cast Mode is designed for shared displays and may permit people with physical access to the screen to view household information or use interactive controls. You are responsible for choosing an appropriate location, device-security settings, and content for any shared display.
The Service is a coordination tool, not an emergency, medical, childcare, financial, or professional-advice service. Do not rely on it for time-critical safety communications.
4. Your content
You retain ownership of content you submit to Plixie. You grant Plixie a nonexclusive, worldwide, royalty-free license to host, reproduce, format, transmit, display, and otherwise process that content only as reasonably needed to operate, secure, improve, and provide the Service and connected features you request. This license ends when the content is deleted from active systems, except for reasonable backup, legal, security, and shared-household retention.
You represent that you have the right to add the content and to share it with the household members you select. Do not upload content that is unlawful, infringing, threatening, abusive, deceptive, invasive of privacy, or likely to compromise another person's safety.
Content added to a shared household may remain part of the household record after you leave. You should remove personal content before leaving when appropriate, or ask an adult household manager for assistance.
5. Acceptable use
You may not:
- use the Service for unlawful, fraudulent, harmful, or abusive activity;
- access another household or account without authorization;
- probe, disrupt, overload, bypass, or interfere with security or access controls;
- scrape, copy, reverse engineer, or automatically access the Service except as permitted by law or written authorization;
- introduce malware or use the Service to send spam or deceptive invitations;
- impersonate another person or misrepresent your authority over a child or household;
- use household or child information for advertising, profiling, harassment, surveillance, or other purposes unrelated to legitimate household coordination; or
- help another person do any of the above.
We may investigate suspected misuse and restrict or suspend access when reasonably necessary to protect users, households, Plixie, or others.
6. Connected and third-party services
Plixie may connect with services such as Google Calendar, Google Sign-In, Sign in with Apple, calendar feeds, and Paddle. Your use of those services is also governed by their terms and privacy policies.
When you connect a calendar, you authorize Plixie to access and process the calendars and events you select and, where enabled, to create, update, or delete synchronized events at your direction. You are responsible for confirming which calendars are selected and for reviewing synchronized changes. Plixie is not responsible for changes made by another user, provider outage, expired authorization, duplicate event, or synchronization delay outside our reasonable control.
We do not control third-party services and cannot guarantee their availability, security, or continued compatibility. You may disconnect a service, but doing so may limit related features.
7. Subscriptions, trial, and automatic renewal
Plixie currently offers a household subscription at $7.99 per month or $59.99 per year, with a 30-day trial that requires payment details, unless different pricing or trial terms are clearly shown before checkout. The price and terms displayed at checkout control your purchase.
One subscription supports up to six household members, including the household owner. Reasonable technical and anti-abuse limits may also apply.
At the end of the trial, the selected plan automatically renews and Paddle charges the payment method on file unless the subscription is canceled before the trial ends. Monthly plans renew monthly and annual plans renew annually until canceled. Taxes may be added as required and are calculated at checkout.
You authorize Paddle, as Plixie's merchant of record, to charge the payment method provided for the subscription, renewals, taxes, and authorized adjustments. Paddle provides the checkout, receipt, invoice, payment processing, and customer billing portal under its buyer terms.
We may change prices prospectively. We will give advance notice when required by law, and a price change will take effect no earlier than your next renewal after the stated notice period. Continuing the subscription after the new price takes effect constitutes acceptance where permitted by law.
8. Cancellation, failed payments, and access
You may cancel through the Plixie billing page and Paddle customer portal. To ensure the cancellation is processed before the next charge, submit it at least two calendar days before the renewal date shown in Billing. If Paddle confirms a cancellation before the renewal charge is processed, the subscription will not renew. Cancellation takes effect at the end of the current trial or paid billing period, and you retain access through that date.
If a charge fails, we or Paddle may retry it and ask you to update payment information. Plixie may provide a short grace period, currently three days, but is not required to continue access indefinitely. If payment remains unsuccessful, household paid access may be limited or suspended.
Deleting the Plixie app, leaving a household, or discontinuing use does not by itself cancel a subscription. Use the billing portal or contact support.
Plixie does not offer voluntary refunds or prorated credits. Refunds are available only when required by applicable law, for qualifying defects or billing errors, or when Paddle approves a refund under its buyer terms or refund policy. See the Plixie Refund Policy for details.
9. Communications
You agree to receive service-related communications needed to operate your account, such as verification, security, invitation, synchronization, billing, subscription, and policy notices. These are not marketing messages and may continue while your account or subscription is active.
We will send marketing communications only when permitted by law. You may opt out of marketing email using the unsubscribe method provided, but you will continue to receive necessary service messages.
10. Plixie intellectual property
The Service, including its software, design, branding, interfaces, and Plixie-created content, is owned by Plixie or its licensors and protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to use the Service for personal and household purposes.
No right is granted to use Plixie's name, logo, or trademarks without written permission. If you provide feedback, you permit us to use it without restriction or payment, but we will not identify you publicly without permission.
11. Suspension, termination, and deletion
You may stop using the Service at any time and may use available account-deletion controls. A household manager's deletion of a household may affect every member and may be irreversible after applicable backup periods.
We may suspend or terminate access when you materially breach these Terms, fail to pay, create security or legal risk, or misuse the Service. When reasonably possible, we will provide notice and an opportunity to correct the issue. We may act immediately when necessary to protect a person, household, Plixie, or the Service.
Provisions that by their nature should survive termination—including payment obligations, ownership, disclaimers, liability limits, indemnity, and dispute provisions—will survive.
12. Service changes and availability
We aim to provide a reliable Service but do not promise uninterrupted or error-free availability. We may maintain, modify, discontinue, or replace features. If we discontinue the paid Service as a whole during a prepaid period, we will provide any refund required by law and may provide a prorated refund.
13. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available." Plixie disclaims implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will always be available, error-free, secure, or accurate, or that calendar synchronization will be instantaneous or complete.
Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you. Nothing in these Terms limits non-waivable consumer rights.
14. Limitation of liability
To the maximum extent permitted by law, Plixie and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption, arising from the Service—even if advised that such damages were possible.
To the maximum extent permitted by law, Plixie's total liability for all claims arising from or relating to the Service will not exceed the greater of (a) the amount you paid for Plixie during the 12 months before the event giving rise to the claim or (b) US $100.
These limits do not apply to liability that cannot legally be limited, including liability for fraud, willful misconduct, or personal injury caused by negligence where applicable law prohibits limitation.
15. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Plixie and its owners, employees, and contractors from third-party claims arising from your unlawful use of the Service, your content, your breach of these Terms, or your violation of another person's rights. This obligation does not apply to the extent a claim was caused by Plixie's own breach, negligence, or unlawful conduct.
16. Governing law and disputes
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Any dispute not resolved informally will be brought in an appropriate state or federal court located in Tennessee, and each party consents to those courts' jurisdiction.
Before filing a claim, you and Plixie agree to try in good faith for 30 days to resolve the dispute by written notice sent to the contact information below. This section does not prevent either party from seeking urgent injunctive relief or using an eligible small-claims court.
If you are a consumer, this section does not deprive you of mandatory rights or the protections of courts in your place of residence that cannot be waived by contract.
17. Changes to these Terms
We may update these Terms as the Service or law changes. We will post the revised Terms with a new effective date and give additional notice of material changes when required. If a change materially reduces your rights during a prepaid period, it will apply prospectively unless law or security requires otherwise. Continuing to use the Service after the effective date means you accept the revised Terms where permitted by law.
18. General terms
These Terms, the Privacy Policy, Refund Policy, and any checkout terms presented to you form the agreement between you and Plixie regarding the Service. Paddle's buyer terms separately govern the purchase transaction it processes as merchant of record.
If a provision is unenforceable, it will be modified only as much as necessary and the remainder will continue. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them in connection with a reorganization, financing, merger, acquisition, or sale of the business. There are no third-party beneficiaries except as expressly stated.
